What happens next in the DUI investigation?

While criminal charges address the state's case against an impaired driver, families of victims often face a parallel process to secure their own future.

Candice Bond, managing partner at Bond Legal, who is also a national legal analyst for Accident News, said, "Fatal crashes involving suspected alcohol impairment frequently create investigative challenges because speeding, darkness, distracted driving, and delayed emergency response conditions sometimes complicate evidence collection during stages following roadway impacts."

Serving as an advocate, an attorney may preserve witness statements, analyze surveillance footage, evaluate vehicle speed calculations, coordinate toxicology consultations, review search warrant documentation, and address financial pressures affecting surviving relatives.

How does this impact the White City community?

The sudden loss of two family members in a preventable collision leaves a devastating void, highlighting the severe consequences of impaired driving on local roads.

According to Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal, "An experienced attorney can help affected families by meticulously reviewing forensic evidence, challenging insurance delays, and securing the stability and resources they need after a devastating collision."

Individuals involved in DUI incidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.

Oregon wrongful death statute

Under ORS § 30.020, surviving family members may file a wrongful death action. Oregon applies modified comparative fault (51% bar). The statute of limitations is 3 years.

Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.
