Brittany Jacks, 31, of Atlanta, was arrested and charged with driving under the influence, serious injury by vehicle and failure to yield following the collision.

Investigators said a southbound 2020 Chevrolet Trax attempted a left turn and entered the path of an oncoming northbound 2001 Mercedes E320.

Russell, a passenger in the Mercedes, suffered minor injuries and was transported for treatment. Two other passengers in the vehicles suffered serious injuries and were transported to Wellstar Kennestone Hospital.

The 18-year-old driver of the Mercedes declined medical treatment at the scene.

The crash remains under investigation. Police are asking anyone with information to contact the department.

How does a DUI charge impact liability in a Cobb County crash?

When a driver faces criminal charges such as driving under the influence, the investigation often runs parallel to civil claims pursued by injured passengers like Russell. National Legal Analyst Stefano Formica, Of Bond Legal, noted that "In car accidents involving impaired driving, the criminal proceedings establish a baseline of negligence that significantly strengthens the civil claims of injured passengers seeking compensation for their medical care."

According to the Georgia Department of Transportation, alcohol-impaired driving remains a leading cause of injury collisions across the state, frequently resulting in severe multi-vehicle impacts at intersections.

What are the rights of passengers injured in a two-vehicle collision?

Passengers injured in collisions have distinct legal standing, as they are rarely found at fault for the crash mechanics. National Legal Analyst Candice Bond, Managing Partner at Bond Legal, noted that "Passengers injured in motor vehicle accidents have the right to pursue claims against the at-fault driver's insurance, and in cases of severe impairment, investigators may also examine whether a commercial establishment over-served the driver."

Investigators will continue to review evidence from the corner of Cumberland Parkway and Mt. Wilkinson Parkway to finalize their report and support the pending criminal charges.

Georgia personal injury claims

Injured parties generally have two years from the date of the crash to file a personal injury lawsuit in Georgia. Prompt documentation of all medical evaluations and treatments is essential for building a full claim against the liable insurance policies, and in cases of severe impairment, dram shop laws may also apply to establishments that over-served the driver.
