Mason Ruggaber fatal motorcycle accident on Route 9W, Glenmont, New York

The fatal collision occurred at the intersection of Route 9W and Magee Drive

Mason Ruggaber, 19, of Delmar, was killed in a motorcycle accident with an SUV on Route 9W near Magee Drive in Glenmont on April 27, according to the Bethlehem Police Department.

The northbound motorcycle and a southbound SUV collided at the intersection, investigators said. The impact left the rider with fatal injuries.

Ruggaber was pronounced dead at the scene. Paramedics took the 53-year-old driver of the SUV to Albany Medical Center Hospital for treatment of non-life-threatening injuries.

The crash remains under investigation by the department's crash reconstruction personnel to determine the cause. Police said the SUV driver is cooperating with authorities.

Liability in intersection collisions

The sudden loss of a life leaves families searching for answers. While police continue to investigate the sequence of events on Route 9W, independent analysis is often necessary to understand the full scope of liability in intersection collisions.

Candice Bond, Managing Partner at Bond Legal, stated, "Motorcyclists are among the most vulnerable on the road because they lack the protection of other vehicles."

Data from the National Highway Traffic Safety Administration shows that motorcyclists account for 15% of all U.S. traffic deaths, despite making up a small fraction of vehicles on the road. Families who lose a loved one in these sudden collisions often face complex insurance and liability frameworks as the investigation concludes.

The role of legal representation

Investigators will review skid marks, vehicle damage, and potential witness statements to determine why the southbound SUV and northbound motorcycle collided.

Stefano Formica, of Bond Legal, noted that "An attorney can protect victims from large insurance companies and their team of lawyers while diligently examining the facts of an accident. An attorney will vigorously advocate for a family who has lost a loved one, ensuring that their legal rights are protected." Route 9W remained closed for several hours while emergency crews cleared the wreckage.

New York wrongful death statute

Under N.Y. EPTL § 5-4.1, surviving family members may file a wrongful death action. New York applies pure comparative fault. The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of parental guidance, funeral expenses, and the decedent's conscious pain and suffering.

Formica, of Counsel at Bond Legal, noted that "Separate from criminal charges, a victim’s family may be entitled to compensation through a civil lawsuit against the responsible party."
