Morgan Destiny Moore struck by vehicle on Lucerne Avenue in Lake Worth Beach, Florida

Palm Beach County records rise in pedestrian-involved collisions over 5-year period

Morgan Destiny Moore, 31, of Lake Worth Beach, died March 23, after a car hit her on Lucerne Avenue, the Palm Beach County Sheriff’s Office said.

The crash happened near North Lakeside Drive. A westbound Hyundai Genesis struck Moore as she crossed the road. The car hit Moore with its front right side, throwing her onto the pavement.

Paramedics arrived at the scene around 7:59 p.m. Rescuers rushed Moore to St. Mary’s Medical Center with critical injuries. She died at the hospital around 9:04 p.m., authorities said.

The driver, 70-year-old Michael Misisco of Palm Beach, stayed at the scene and cooperated with deputies. Deputies found no signs of alcohol or drug impairment in the driver. No charges have been filed.

The sheriff's office Traffic Division is investigating the crash.

Investigation into the Crash

The crash that killed Moore is under investigation. These investigations look into the circumstances of the crash.

National Legal Analyst Candice Bond, Managing Partner at Bond Legal, said that "Road conditions, signage visibility, and road lighting are all possible contributing factors that are considered and must thoroughly be examined. These procedures are necessary for helping those who have lost a loved one receive the justice and monetary compensation that they deserve."

According to the Governors Highway Safety Association (GHSA), pedestrian deaths reached 7,593 in 2022. Preliminary 2024 data shows a slight decline, but the numbers are still almost 20% higher than in 2016. In Florida, pedestrians often make up more than 20% of all traffic deaths.

As the cause and liability of a crash are investigated, Stefano Formica said a competent attorney should handle investigations in cases like this. This helps protect the rights of the victim and their family.

Formica, Of Counsel at Bond Legal, said that "Walking accidents often involve a lot of confusion about who had the right of way at the time of the collision. Checking for nearby security cameras or dashcam footage can provide the clear answers needed to understand what happened. This clarity helps a victim feel more secure as they work through their medical recovery."

Legal analysts also say that infrastructure often plays a role in these outcomes. In many Florida cities, a lack of mid-block crossings or not enough lighting creates dangerous conditions that contribute to road safety problems.

Florida wrongful death claims

Florida Statute § 768.16-768.26 outlines the framework for wrongful death claims in the state. This statute allows specific surviving family members, such as spouses, children, and parents, to pursue legal action when a death results from another party's negligence or wrongful act. These claims can seek compensation for both economic and non-economic losses experienced by the survivors.

Bond noted that in cases involving pedestrian death, a driver's "duty of care" is a key element in legal evaluations. This concept suggests that drivers are expected to exercise heightened caution in areas where pedestrians are present.

Statute of limitations and damages in Florida

In Florida, a wrongful death claim generally must be filed within a two-year statute of limitations, calculated from the date of the deceased's passing. Recoverable damages in such cases may encompass funeral and medical expenses, loss of future income, and compensation for the loss of companionship and protection. The state's comparative fault system may also be applied, which assesses and distributes liability among all parties involved in an incident.
