The crash occurred on Highway 164 approximately three miles west of the city limits
Two Waco residents were killed in a three-vehicle car accident on Highway 164 near Mart, Texas, early Thursday, according to the Department of Public Safety.
A Nissan Sentra crossed the center line for unknown reasons and struck a Ford Escape head-on. A Nissan Rogue was also involved in the collision, which occurred approximately three miles west of the city limits around 6:10 a.m.
The identities of the deceased have not been released.
The crash remains under investigation.
Why did the vehicle cross the center line on Highway 164?
When a driver crosses a highway center line, the resulting head-on collisions often require extensive forensic analysis. While the exact cause of the crossover remains under investigation, National Legal Analyst Candice Bond, Managing Partner at Bond Legal, stated, "When I hear about high-speed collisions, I think about the heavy grief those families carry. A car's black box captures the five seconds before impact, showing if there wasn't even a tap on the brakes."
How common are fatal highway crashes in Texas?
According to the Texas Department of Transportation, 4,283 people died in traffic crashes statewide in 2023. Rural highways frequently see a higher share of fatal impacts per mile driven compared to urban areas.
Understanding the mechanics of a highway crossover requires thorough accident reconstruction. National Legal Analyst Stefano Formica, Of Bond Legal, added, "The suddenness of a highway crash is something no family is ever prepared to face. Data shows that the speed differential between vehicles, not absolute speed, is the strongest predictor of how survivable an impact will be."
Texas wrongful death statute
Under Tex. Civ. Prac. & Rem. Code § 71.001, surviving family members may file a wrongful death action. Texas applies modified comparative fault (51% bar). The statute of limitations is 2 years.
Recoverable damages may include loss of financial support, loss of companionship and consortium, funeral expenses, and mental anguish.
