California wrongful death statute

Under California law, the family of an individual killed in a motor vehicle collision may pursue a wrongful death claim. This type of claim allows eligible family members to seek compensation for damages such as funeral and burial expenses, the loss of financial support the deceased would have provided, and the loss of companionship, comfort, and moral support.

A separate legal action, known as a survival action, may also be pursued on behalf of the deceased's estate. This action seeks to recover damages the deceased person incurred between the time of injury and the time of death, which can include medical expenses and lost income.

Determining liability in California collisions

In collisions, particularly head-on incidents, determining liability often involves a detailed examination of several factors. Investigators typically review vehicle positioning at rest, analyze electronic data recorders from the vehicles, and assess for potential mechanical failures that may have contributed to the crash. Physical evidence from the scene, such as damage to roadside infrastructure, can also be important in reconstructing the event.

Bond noted that liability in such cases is established by demonstrating negligence. This involves showing that a party owed a duty of care, breached that duty, and this breach directly caused the death.
