The fatal collision occurred on Interstate 20 between Dowdy Ferry Road and St. Augustine Road
Abel Zamudio Gamboa, 39, was killed in a hit-and-run crash on Interstate 20 between Dowdy Ferry and St. Augustine roads in Dallas County on July 15, according to the Sheriff's Office.
Elana Kaye Peronis, 28, was arrested Thursday and booked into the Dallas County Jail on a charge of collision involving death. Investigators located the suspect after a local business owner recognized the description of the fleeing vehicle on the news and reported that an employee had returned a damaged company van.
The crash occurred just after midnight when a disabled 18-wheeler was stopped on the eastbound highway shoulder. A second semi-truck driver arrived to deliver a replacement part, and while the driver of the disabled truck was outside making repairs, a passing white van veered onto the shoulder and struck Gamboa.
The van driver fled the scene without rendering aid. According to investigators, the suspect later told her employer she believed she had struck a dog.
The Vehicle Crimes Unit continues to investigate the collision.
Bond has not yet been set for the suspect.
How does the arrest impact the investigation on Interstate 20?
While the criminal justice system pursues charges against the driver who fled the Dallas County scene, the victim's family faces a separate legal process.
The involvement of a company van introduces complex third-party liability factors.
Candice Bond, managing partner at Bond Legal, said, "When a driver leaves the scene of a fatal collision, surviving relatives face compounded trauma alongside legal and financial uncertainty. Investigations become exponentially harder as critical details vanish and responsible parties slip away."
"An attorney becomes essential, directing scene reconstruction specialists, gathering witness statements before memories fade, analyzing event data from vehicles involved, and ensuring insurance carriers fulfill obligations to affected families," added Bond, who is also a national legal analyst for Accident News.
According to the AAA Foundation for Traffic Safety, hit-and-run death have trended upward, with 2,872 people dying in such crashes nationwide in 2023.
What role does commercial liability play in this hit-and-run?
Because the suspect was driving a company vehicle, investigators will examine whether she was operating within the scope of her employment at the time of the crash. Corporate insurance policies often carry higher coverage limits than personal auto policies, but establishing vicarious liability requires thorough documentation.
Families of victims like Gamboa are often left navigating deep grief while simultaneously dealing with aggressive corporate insurance adjusters.
Texas wrongful death statute
Under Tex. Civ. Prac. & Rem. Code § 71.001, surviving family members may file a wrongful death action. Texas applies modified comparative fault (51% bar). The statute of limitations is 2 years.
Recoverable damages may include loss of financial support, loss of companionship and consortium, funeral expenses, and mental anguish.
"Grieving families deserve accountability and financial recovery following fatal hit-and-run collisions, yet investigation obstacles and insurance barriers frequently complicate both goals simultaneously," said Stefano Formica, of counsel at Bond Legal.
"Legal counsel coordinates those investigative elements, partners with police, secures digital evidence, analyzes crash mechanics, and advocates for families navigating wrongful death claims," noted Formica, who is also a national legal analyst for Accident News.
