Alfredo De La Torre Killed in El Paso Hit-and-Run Accident

Suspect with prior felony convictions arrested after fleeing deadly motorcycle collision on Loop 375
Alfredo De La Torre, 44, and his wife, Miriam De La Torre, 42, both of Horizon City, were killed in a hit-and-run crash on Loop 375 near Yarbrough on Sunday, according to the El Paso Police Department.
The suspect faces serious charges. David McCall, 21, was arrested and booked on two counts of collision involving death after he allegedly lost control of a 2025 Kia Forte and struck the 2022 Suzuki GSX.
The impact threw Alfredo and Miriam from the bike, fatally injuring them. The driver of the Kia attempted to flee the scene on foot but was apprehended by officers shortly after the collision.
Court records indicate McCall was previously convicted in 2024 and sentenced to four years in prison for smuggling persons and evading detention. He is currently being held with bail pending.
A candlelight vigil was held Monday night by local motorcycle riders to honor the couple.
The deaths mark the 27th and 28th traffic death in the city this year.
The sudden loss of Alfredo and Miriam De La Torre leaves their family navigating both deep grief and a complex criminal justice process. While El Paso police have secured an arrest, a thorough examination of a crash site remains critical to building a full civil case alongside the criminal proceedings.
Candice Bond, managing partner at Bond Legal, said, "Fatal hit-and-run crashes leave grieving families desperately searching for answers while a driver vanishes into traffic within seconds, erasing critical clues before rescue crews ever arrive."
"An attorney often steps in early, coordinating with investigators to track down nearby surveillance footage, recover scattered vehicle debris, and build a timeline strong enough to identify a driver before crucial evidence disappears completely," added Bond, who is also a national legal analyst for Accident News.
According to the AAA Foundation for Traffic Safety, hit-and-run fatalities nationwide have climbed to historic highs, with Texas consistently ranking as one of the deadliest states for these collisions.
What criminal charges does the suspect face in El Paso?
McCall is currently facing two counts of collision involving death. In Texas, fleeing the scene of a fatal crash is a severe felony. However, criminal prosecution is only one avenue for accountability. Families of victims killed by reckless or fleeing drivers often pursue parallel civil actions to secure financial support for funeral expenses, loss of income, and loss of companionship.
How do hit-and-run investigations impact surviving families?
When a driver loses control and flees, the burden often falls on the victims' estate to handle insurance claims and legal deadlines. Independent investigators frequently review police reports, vehicle data recorders, and prior criminal records to establish a clear timeline of negligence.
Texas wrongful death statute
Under Tex. Civ. Prac. & Rem. Code § 71.001, surviving family members may file a wrongful death action. Texas applies modified comparative fault (51% bar). The statute of limitations is 2 years.
Recoverable damages may include loss of financial support, loss of companionship and consortium, funeral expenses, and mental anguish.
"Electronic data review after a fatal crash examines information stored inside modern vehicles, covering speed, braking, and steering input recorded moments before impact occurred," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.
