According to final National Highway Traffic Safety Administration (NHTSA) data, 1,166 pedalcyclists were killed in US traffic crashes during 2023.
The sudden loss of a teenager in a traffic collision deeply impacts a community, leaving families searching for understanding.
While the cause of a crash is being investigated, it is important that a competent attorney handles investigations into cases such as this to ensure the rights of the victim's family are protected.
Candice Bond, managing partner at Bond Legal, said, "Bicyclists face inherent disadvantages in collisions with automobiles simply due to physics and the absence of metal frames, airbags, or crumple zones. Serious crashes result in catastrophic injuries and frequently prove fatal because bicycles offer virtually no crash protection."
"An attorney working with surviving relatives focuses on gathering investigative materials, analyzing driver conduct, reviewing insurance coverage, and ensuring families receive appropriate legal protections," added Bond, who is also a national legal analyst for Accident News.
Investigators are examining visibility, speed, and lighting conditions at the time of the 11:23 p.m. collision. Troopers will review physical evidence, including skid marks and vehicle damage, to reconstruct the sequence of events leading up to the impact.
Families who lose a loved one in a collision often face significant emotional and financial burdens. A thorough independent investigation helps clarify liability and ensures all causes are identified.
Under Cal. Code Civ. Proc. § 377.60, surviving family members may file a wrongful death action. California applies pure comparative fault. The statute of limitations is 2 years from the date of death.
Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.
"Insurance coverage disputes frequently complicate matters for families after fatal bicycle accidents because policies contain exclusions, coverage limits, and claim procedures that families must navigate," said Stefano Formica, of counsel at Bond Legal.
"Legal counsel addresses insurance complications by reviewing policy language and helping families understand available compensation while protecting financial interests during vulnerable periods," noted Formica, who is also a national legal analyst for Accident News.
