How common are pedestrian death on Louisiana highways?

Families navigating the sudden loss of a loved one in a pedestrian collision often face a complex path forward.

Candice Bond, managing partner at Bond Legal, said, "The hardest part for many families is that the window to preserve critical evidence closes quickly, often before they have had any time to grieve. Getting legal help early means someone is fighting to lock down the footage, the records, and the documentation that gives a family something solid to stand on going forward."

"A driver who looks away from the road for even a few seconds can end a life, and that reality is something families in these cases live with forever," added Bond, who is also a national legal analyst for Accident News.

What factors do investigators examine in multi-vehicle pedestrian crashes?

"With multiple vehicles involved, blind spot dynamics become critical, because a pedestrian that one driver can see may be completely invisible to another," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.

"Understanding the size, position, and sightlines of every vehicle in that collision is foundational work, because those physical realities often explain how someone on foot ended up in a fatal situation."

When multiple vehicles strike a pedestrian, crash reconstructionists must evaluate lighting, vehicle speeds, and right-of-way to determine liability. Investigators will also review the sequence of impacts to understand how the collision unfolded on the highway.

Louisiana wrongful death statute

Under La. Civ. Code Art. 2315.1, surviving family members may file a wrongful death action. Louisiana applies pure comparative fault. The prescriptive period is 1 year from the date of death.

Recoverable damages may include loss of financial support, loss of love and affection, funeral expenses, and the decedent's pain and suffering.
