Detectives arrested 20-year-old Malachi Thibodeaux of Grand Coteau and booked him into the Lafayette Parish Correctional Center on a charge of hit-and-run resulting in death. Investigators identified him as the driver who fled the scene after the collision.

The southbound 2014 Ford Focus struck Vargas' electric scooter from behind shortly after 9:15 p.m.

Paramedics pronounced Vargas dead at the crash site.

Investigators collected a standard toxicology sample for analysis as the investigation continues.

The sudden loss of a loved one in a hit-and-run collision leaves families devastated and searching for answers while the criminal justice system processes the at-fault driver. When a drivers flees the scene of a fatal crash, families often face complex legal hurdles even after an arrest is made.

Candice Bond, managing partner at Bond Legal, said, "Catastrophic collisions generate enormous medical expenses, and when the driver responsible cannot be identified, surviving relatives face serious financial uncertainty overnight. Uninsured motorist coverage may offer a meaningful path forward, but navigating that process while grieving is difficult."

"An experienced attorney can manage those insurance negotiations and protect families from being pushed toward inadequate settlements," added Bond, who is also a national legal analyst for Accident News.

How do criminal charges affect civil liability in Carencro?

While criminal charges like hit-and-run resulting in death punish the offender, they do not automatically compensate the victim's family for their loss. Parallel civil claims are often necessary to secure financial support for the estate.

What are the next steps for the victim's family?

E-scooter riders face extreme vulnerability on service roads and highways. According to the U.S. Consumer Product Safety Commission, 111 e-scooter-related deaths occurred nationwide between 2017 and 2022.

As investigators continue to build the criminal case against the driver, the victim's family must handle the immediate aftermath of the tragedy. Individuals involved in fatal hit-and-run incidents may have legal options. Consulting a personal injury attorney can help clarify rights and potential claims.

Louisiana wrongful death statute

Under La. Civ. Code Art. 2315.1, surviving family members may file a wrongful death action. Louisiana applies pure comparative fault. The prescriptive period is 1 year from the date of death.

Recoverable damages may include loss of financial support, loss of love and affection, funeral expenses, and the decedent's pain and suffering.

"Wrongful death claims allow surviving relatives to seek compensation for financial losses a criminal conviction alone cannot address, covering lost income, funeral expenses, and long-term economic hardship. Navigating that process while managing grief is genuinely overwhelming," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.

"An attorney can handle those full procedural demands so families can focus on each other rather than on courtrooms."
