Michael Menjares Killed in Abilene Car Accident

Michael Menjares car accident on West Lake Road, Abilene, Texas

Four passengers injured after SUV rolls into drainage ditch on West Lake Road

Texas roads see a reportable crash every 57 seconds, adding to a statewide toll that claimed 4,150 lives in 2024, according to the State Department of Transportation.

Michael Menjares, 17, of Abilene, was killed in a rollover crash in the 6500 block of West Lake Road early Sunday, according to the Abilene Police Department.‌‌‌‍‍‍‍‌‌‌‌‌‍‌‌‍‍‍‍‍‌‍‍‍‍‌‍‌‍‌‍‍‌‌‌‍

When first responders arrived at the scene around 12:52 a.m., they found a Toyota RAV4 that had rolled over into a grass-lined drainage ditch. Four occupants in the SUV were taken to a local hospital with undisclosed injuries. Menjares was pronounced dead at the scene.

Investigators said the southbound vehicle veered to the right before leaving the road. Police do not believe intoxication was a factor in the crash.

The Abilene Police Department’s Traffic Division continues to investigate the crash.

Investigating fatal single-vehicle rollover crashes

While the exact cause of the crash remains under investigation, single-vehicle rollovers often involve complex factors. In fatal motor vehicle accidents such as this, investigators look closely at vehicle dynamics, drainage ditch design, and how the driver responded before the rollover.

Candice Bond, managing partner at Bond Legal, said, "Rollover crashes impose forces on occupants that most people simply cannot picture, with the vehicle rotating violently, the roof folding inward, and any occupant not fully restrained becoming a projectile inside or outside the vehicle."

An attorney working with surviving relatives can secure physical evidence, bring in reconstruction specialists, and ensure insurance carriers are held accountable throughout the process, Bond added.

What makes fatal rollover crashes particularly challenging from an investigative standpoint?

The four surviving passengers and the family of Menjares face a difficult recovery process.

"Fatal rollover crashes are among the most forensically complex events that accident investigators encounter, partly because the sequence of impacts, rotation angles, and ejection paths must each be reconstructed separately," noted Stefano Formica, a national legal analyst for Accident News and of counsel at Bond Legal.

"Legal counsel stepping in early can preserve event data recordings, retain engineering experts before evidence degrades, and protect affected families from insurance tactics designed to minimize legitimate claims."

According to the National Highway Traffic Safety Administration, single-vehicle rollovers account for a disproportionate number of fatal injuries nationwide, particularly among younger passengers.

Texas wrongful death statute

Under Tex. Civ. Prac. & Rem. Code § 71.001, surviving family members may file a wrongful death action. Texas applies modified comparative fault (51% bar). The statute of limitations is 2 years.

Recoverable damages may include loss of financial support, loss of companionship and consortium, funeral expenses, and mental anguish.
