Peggy Jane Holt hit and run accident on Claribel Road, Stanislaus County, California

19-year-old driver arrested on felony charges after fleeing the scene on Claribel Road

Peggy Jane Holt, 79, of Modesto, was killed in a hit-and-run pedestrian accident on Claribel Road west of Langworth Road in Stanislaus County on Tuesday, April 7, according to the California Highway Patrol.‍‌‌‍‌‌‌‌‌‍‍‌‌‍‍‌‌‌‌‌‍‍‌‌‌‍‍‌‌‍‍‌‌‌‍‍‍‌‌‍‌‌‌‌‌‍‍‌‌‍‍‌‌‌‌‌‍‍‌‌‌‍‍‌‌‍‍‌‌‌‍‍

Investigators arrested 19-year-old Eduardo Diaz of Riverbank the following day and booked him into the Stanislaus County Jail on a felony hit-and-run charge. Officers located the involved white pickup truck on Pocket Avenue with assistance from Riverbank police and seized it for evidence.

Emergency personnel responded to a call about the crash around 9 p.m. Responders found Holt lying on the north shoulder of the road, where she was pronounced dead at the scene.

Initial reports indicated the pickup was traveling westbound immediately after the collision. The crash remains under investigation by the CHP Modesto Area Office.

While the criminal justice system pursues felony charges against the arrested driver, the victim's family must simultaneously work through the civil legal framework. Swift arrests in these cases often rely on rapid evidence collection before a vehicle can be hidden or repaired.

"It's amazing how much evidence a simple doorbell camera can provide after a neighborhood collision. Between residential cameras and plate readers, most hit-and-run drivers are caught within forty-eight hours if there's any evidence left," said Candice Bond, Managing Partner at Bond Legal.

What evidence connects the white pickup to the Claribel Road scene?

Investigators seized the suspect's vehicle on Pocket Avenue the day after the fatal collision. In hit-and-run pedestrian accidents, authorities typically examine the vehicle's front end and undercarriage for physical damage, biological evidence, and paint transfer that matches debris left on the road shoulder.

How does a felony hit-and-run charge impact the civil case?

A criminal arrest establishes a strong foundation for a parallel civil claim. When a driver faces felony charges for fleeing a fatal scene, their documented actions can serve as negligence per se in a wrongful death lawsuit.

"The data on hit-and-run fatalities shows that someone is killed every four hours in this country. Most drivers don't realize that neighborhood doorbell cameras have become the top source for identifying fleeing vehicles," stated Stefano Formica, Of Bond Legal

The California Office of Traffic Safety ranks the state among the highest in the nation for fatal hit-and-run collisions, highlighting the importance of holding fleeing drivers accountable through both criminal and civil avenues.

California wrongful death statute

Under Cal. Code Civ. Proc. § 377.60, surviving family members may file a wrongful death action. California applies pure comparative fault. The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.
