Salome Cigarrero Guevara DUI accident on Central Expressway, Sunnyvale, California

Brian Burke charged with murder after wrong-way collision on Central Expressway

Salome Cigarrero Guevara, 52, of Mountain View, was killed in a wrong-way DUI accident on Central Expressway near Commercial Street in Sunnyvale, Santa Clara County, California, on Thursday, April 9, according to the Sunnyvale Department of Public Safety.

Brian Burke, 34, of San Jose, was charged with murder and remains in custody without bail. Prosecutors said he was driving a Ford F-150 pickup truck in the wrong direction when he struck an oncoming Jeep Compass head-on.

The collision severely damaged both vehicles. Officers found Guevara trapped in the driver's seat of the Jeep, and she was pronounced dead at the scene.

Burke was found in the driver's seat of his truck. He was arraigned Monday and is scheduled to appear in court again on June 2.

Guevara was driving home from her job at Denny's when the crash occurred just before midnight. The incident remains under investigation.

The sudden loss of a loved one to an impaired driver leaves families grappling with both deep grief and a complex legal aftermath. While criminal charges address the state's case against the driver, the family of Guevara faces a separate path toward accountability.

"The loss of a life to a drunk driver is a preventable tragedy that leaves a permanent scar," said National Legal Analyst Candice Bond, Managing Partner at Bond Legal. "At the legal limit, a driver's reaction time drops by thirty percent and their peripheral vision simply disappears."

How do criminal murder charges affect the Sunnyvale investigation?

In California, prosecutors can file murder charges in fatal DUI cases under specific circumstances, often when a driver has prior convictions or demonstrated extreme recklessness. According to the National Highway Traffic Safety Administration, 12,429 people were killed in alcohol-impaired driving crashes nationwide in 2023, accounting for 30% of all traffic deaths.

What legal avenues exist for families of wrong-way crash victims?

The criminal prosecution of Burke will determine his penal consequences, but it does not automatically provide restitution for the victim's estate. Families navigating the aftermath of a fatal collision often must initiate parallel civil proceedings to secure compensation for funeral expenses, lost income, and loss of companionship.

"The preventable death of a loved one at the hands of a drunk driver is a unique agony," noted National Legal Analyst Stefano Formica, Of Bond Legal"Alcohol-related fatalities have risen by over thirty percent recently, reminding us that these aren't just accidents, they are choices."

Investigators will continue to examine toxicology reports, vehicle data recorders, and surveillance footage from the Central Expressway corridor to build a full timeline of the events leading up to the head-on collision.

California wrongful death statute

Under Cal. Code Civ. Proc. § 377.60, surviving family members may file a wrongful death action. California applies pure comparative fault. The statute of limitations is 2 years from the date of death.

Recoverable damages may include loss of financial support, loss of companionship, funeral expenses, and the decedent's pre-death pain and suffering.
